Does the Supreme Court look at public opinion polls? This is not a new question, but recent decisions may reflect, in the opinion of some, an increased awareness of the “big picture” as opposed to a literal reading of the constitution.
This is a question that is not likely to be resolved, but will probably continue as an area of media commentary and public debate.
Investors would be well advised to set aside their personal political beliefs. Some Supreme Court decisions may have a material impact on business activity in general and/or on specific companies and/or industries. To the extent that decided or pending Supreme Court issues may affect an investor’s current or future portfolio positions, a careful assessment is appropriate. Railing against decisions that you may not like or agree with is counter productive in the investment process.
